A Pre-trial Deferral Program is offered by Marshall County Prosecutor’s Office for those individuals that have a driving record clear of any moving violations for the last three (3) years and who have never been convicted of any type of crime. It is a benefit to those that desire to keep their driving record clear of any moving violation points which would otherwise generally cause an increase in the cost of motor vehicle insurance.

  • Operators with CDL licenses are not eligible for this program.
  • The program requires that you be placed on six (6) months of informal probation.
  • If you complete the six (6) months without any other traffic violations or criminal offenses, the Prosecutor’s Office would dismiss the ticket and it would never appear on your driving record.
  • The cost of the program is $191.50.
  • If you receive another traffic ticket or commit a criminal offense during that six (6) month period then the money paid for the program would be forfeited, the ticket would be redocketed with the Court, and you would have to pay the ticket plus resolve the new violation.
  • If the ticket you received is for a speeding violation in excess of 25 miles over the limit then as a part of the program you would be required to take a defensive driving course. This course is offered through the Bureau of Motor Vehicles in Indianapolis and is a videotape course that can be completed at home.
  • This course must be completed during that six (6) month period.
