Infraction Deferral Program Eligibility

Think you might be eligible?

If you did not receive an invitation to participate in the Infraction Deferral Program and you
think you might be eligible, call or email the Program Coordinator for more information:

Driver MUST meet all the requirements listed below (unless otherwise agreed by a Prosecutor):

• No more than three convictions for moving violations in the past five years.
• No convictions for 8-point offenses such as Driving While Suspended Prior, Failure to
    Yield to an Emergency Vehicle, or speed contest, unless agreed to by the Prosecuting Attorney.
• The current charge is for a moving violation other than any offense involving an accident, passing a 
    school bus when loading or unloading, failing to yield to an emergency vehicle, or any other 8-point offenses
    (as designated by The Indiana Bureau of Motor Vehicles)
• Hold a valid operator's license; Commercial Driver's Licenses (CDLs) ARE NOT ELIGIBLE!

The following moving violations are NOT eligible for the Infraction Deferral Program:

• Any offense involving an accident
• Passing a school bus when loading or unloading
• Failing to yield to an emergency vehicle
• Or any other 8-point offense (as designated by the Indiana BMV)

Eligibility is at the complete discretion of the Marshall County Prosecutor and his representatives
- any driver may be made ineligible for any reason by the Marshall County Prosecuting Attorney
